A local group has filed suit seeking an injunction against the Cedar Bluff Municipal Option election, scheduled for Tuesday Aug. 12.

According to reports, Citizens Caring For Children filed the suit Friday, Aug. 8, in Cherokee County Circuit Court, calling the legislation establishing the election unconstitutional.

“The local law passed by the legislature with disregard to the general law,” said Carl Green, chairman, Citizens Caring For Children. “It is our feeling that the general law cannot be replaced by local legislation without a constitutional amendment. We have made a request through the courts by our attorney that the election be stopped until such time as the law can be tested.”

If the election can’t be stopped, Green said, the group requests that no license for alcohol sales be issued until the justice department rules on the constitutionality of this law.

Upon the advice of his attorney, Cedar Bluff Mayor Bob Davis would not comment on the suit at this time
