According to Attorney Bill Hawkins who read from the State Attorney General’s opinion, “The death of the candidate who received the second most votes in the municipal election effectively withdraws his candidacy in the runoff election, and no runoff election is required. The remaining candidate for mayor in the runoff election should be declared the winner of the election. The candidate receiving the third most votes does not move into second place and become a candidate in the runoff election.”
Upon the reading of this Attorney General opinion, Ethel Sprouse was declared the winner in the mayoral race and will be officially installed as Mayor of Cedar Bluff at the Nov. 9, 2009 meeting. A runoff election for council seats will be held on December 8, 2009 between Billie Burkhalter and Evan Smith for District One; Martha Baker and Jack Bond for District Three and Tammy Crane and Mark Hicks for District Four.
In other business during the 20-minute special called meeting, the council voted to have a five member Utility Board, tabled consideration of taking the garbage truck back into the Town from the Utility Board, and tabled consideration on filling the vacancy on the Cedar Bluff Utility and Solid Waste Authority.
The next meeting will be Tuesday, Nov. 9, at 6 p.m.
